Our client was charged with Convicted Felon in Possession of a Handgun (KRS 527.040) as well as Possession of Marijuana (KRS 218.1422). A review of our clients record indicated that the predicate felony that allowed the government to place the charge against our client was a conviction for Possession of a Controlled Substance First Degree (KRS 218A.1415). Through clever motion practice, we were able to convince the original sentencing court to void and seal the predicate felony, making it impossible for the government to prove the new case against the defendant. As a result, the defendant pled to time served on Possession of Marijuana, and he is no longer a convicted felon.
